OLD LYME PLANNING COMMISSION
PUBLIC HEARING & REGULAR MEETING
JULY 8, 2004



PRESENT WERE:  Chairman Harold Thompson, Robert McCarthy,  Steve Ross and Alternate Nancy Strohla seated for Chris Kerr and Alternates Robert Pierson and Alan Bayreuther.  Also present were Kim Groves, Jeff Flower, Gary Sharpe, Jeff Harris and Tony Hendriks.  

The Chairman called the meeting to order at 7:45 p.m.

The Chairman made a motion to move the first two items on the agenda (Original Division – Bassam Awwa – 24 Lords Meadow and the public hearing for Lords Woods Subdivision to after the regular meeting the reason being a public hearing will not be held tonight.  Robert McCarthy seconded the motion.  The motion passed unanimously.

ORIGINAL DIVISION – DAVIS POND TRACT LIMITED PARTNERSHIP – HUNTLEY ROAD

Mr. Flower presented the proposed division on behalf of the applicant.  Mr. Flower noted that when the original division was applied for the wrong limited partnership name was used, however both the Engineer and Attorney have made the appropriate changes to the documents and plans. Mr. Flower stated the Assessor has assigned 3-1 Huntley Road as the address for the rear lot and the front lot is already 1 Huntley Road.  Mr. Flower noted initially the rear lot had 4 test holes dug on it as opposed to the required 5 test holes which he felt was adequate because the Health Department had approved the site and there was no ledge located on the property or groundwater issues.  He also noted he had not done test holes on the front property because he has no intentions of doing any construction in the front at this point.  Mr. Flower stated, based on the ZEO’s letter, he had the additional required test holes dug and the information was submitted to the commission at the meeting.    He also stated Attorney Marsh has submitted a letter stating the property has had no divisions since 5/2/47.  He stated he currently has an application before the Inland Wetlands commission for the construction of a driveway.   

Steve Ross made a motion to approve the original division subject to corrections and additions added to the mylar.  Connie Kastelowitz seconded the motion.  The motion passed unanimously.

SUBDIVISION – 1 LOT – 10 MILE CREEK ROAD – APPLICANT: JEFFREY M. HARRIS & DONALD WILLIS

Mr. Pierson stated the deeds currently reflect two lots and for some reason there was never a subdivision approved.  Therefore, Ann Brown, ZEO suggested the applicant go through the subdivision process and file in on the land records to remove any further confusion.  Harold Thompson made a motion to receive the application and set for hearing at a date to be determined.  Nancy Strohla seconded the motion.  The motion passed unanimously.

PRELIMINARY DISCUSSION – SUBDIVISION – KENNY ASSOCIATES, INC. 392 SHORE ROAD

Gary Sharpe presented the preliminary plans for the proposed subdivision.  The property is located in the south part of Old Lyme on Route 156.  The proposal would be done in two phases.  The total property is about 22 acres.  The first phase of eleven lots will have access from a proposed Town Road with a cul-de-sac at approximately 550 ft.  In the second phase, three of the lots, including the one existing lot, will be accessed from Shore Road at the southernmost end of the property.  He noted most of the houses will be placed on the ridge or in back of the ridge.  Many of the lots will have their frontage on Route 156.  He noted Lots 1 through 4 would have common access and Lots 5 and 6 would have their own driveways.  The three lots at the other end would also be served by another common access way and Lot 9 would have an easement across Lot 8. The conservation easement consists of approximately 4.5 acres.  Connie Kastelowitz suggested the long driveway be eliminated  and the lot be serviced by proposed common access.   

The commission expressed great concern of adding two additional homes to the existing driveway at the southernmost end of the property.  Mr. Sharpe stated he had met with the DOT and it was probably the best location.  Mr. Thompson asked if there were any alternatives for Phase II rather than entering onto Shore Road right at the corner.   Mr. Sharpe noted this is an existing driveway directly opposite the entrance to Point O’ Woods and he felt it is the best location along this frontage otherwise if you move in either direction you begin to loose sight lines.  Mr. Pierson stated he would like some guarantees that no plantings would ever be placed in the entrance which would alter an already very poor sight line.  Mr. McCarthy also expressed concern of adding the traffic of two additional homes to the Phase II entrance.  

Mr. Thompson asked what size culvert would be used to cross the wetlands in Phase I.  Mr. Sharpe noted it would not be a large culvert because it was not a considerable watershed.

No action was taken.

ARIA, LLC – BROAD BROOK ESTATES – 254 BOSTON POST ROAD – 5 LOT SUBDIVISION

Mr. Hendriks presented the proposed application.  He noted the property is located at 254 Boston Post Road right where the Old Post Road intersects back into Route 1.  The property is 50 acres in size serviced by an existing woods road off of the Boston Post Road.  He noted 16 acres would
be provided as open space which is comprised of both upland and wetland area.  Mr. Hendriks stated 50 percent of the open space is wetlands.  Mr. Hendriks noted he is still currently in the public hearing process with the Wetlands Commission.  

The 5 lots will be accessed by one single paved driveway without curbs using alternate drainage structures.  The application would include a common driveway maintenance agreement.  

He stated the test pits meet both the state and local regulations.  Mr. Hendriks suggested the commission walk the site prior to the public hearing.  Mr. Hendriks stated the Open Space Committee has suggested that the applicant donate about 7 acres in the area of the proposed house locations.  This request would wipe out three of five proposed lots, therefore he did not think is client is willing to do this.  He further stated the open space being donated is the best from both an environmental standpoint.

Connie Kastelowitz asked if this proposal gave the National Guard the access they wanted.  Mr. Hendriks stated he would be more than happy to discuss with the owners the option of providing access on the back side of the property.   

Harold Thompson made a motion to receive the application and set for public hearing at the September meeting.  

READING AND APPROVAL OF THE JUNE  MINUTES

Steve Ross  made a motion to waive the reading of the minutes and approve the June  minutes as presented.  Robert McCarthy seconded the motion.  The motion passed unanimously.

SUBDIVISION – LORDS WOODS – 10 LOTS – LORDS MEADOW DRIVE – BASSAM AWWA

Mr. Hendriks submitted a 35 day extension for the Public Hearing to allow the applicant to address Fire Department issues and notify neighboring property owners of the upcoming hearing.
The application for the original division will be discussed at the same time.

Harold Thompson made a motion to extend the public hearing until the next regularly scheduled meeting on September 9, 2004.  Nancy Strohla seconded the motion.  The motion passed unanimously.
